Welcome to Mudra Magic. These Terms of Use govern your use of our mobile application, hereby known as “the app” or Mudra Magic. In these Terms, “You” will refer to the user of the app, and “we” or “us” will refer to Supreme Ultimate Applications, LLC (the company that created Mudra Magic). By accessing or using Mudra Magic, you agree to comply with and be bound by these Terms of Use. Please read them carefully.
1. General Information
App Name: Mudra Magic
Description: Mudra Magic is an innovative mobile app for health and fitness education, focusing on mudras also known as yogic hand postures. It provides text and interactive 3D models to demonstrate to users exactly how to use mudras to enhance their yogic and meditative practices.
2. User Engagement and Content
Account Registration: No account registration is required to use Mudra Magic.
User-Generated Content: The only content the user generates in the Mudra Magic app is certain technical data used for analytics and diagnostic purposes to improve Mudra Magic.
3. Acceptable Use
Users must use Mudra Magic in a manner that is lawful and respectful of others. No specific activities or behaviors are explicitly prohibited within the app.
4. Age Restrictions
There is no minimum age requirement for users of Mudra Magic. However, users should ensure they are capable of understanding and following these Terms of Use.
5. Payments
Mudra Magic prides itself in its authenticity as a meditation tool. It delivers a premium, ad-free experience for a one-time fee of $2.99
6. Data Collection and Use
Supreme Ultimate Applications, LLC collects certain technical data such as device specifications in order to improve Mudra Magic and keep it functioning properly over time. Additionally, we use third-party services such as Google and/or Apple analytics and SquareSpace analytics in order to collect and monitor data based on user interactions with the Mudra Magic app, with our website https://www.taijitek.net, and with our advertisements.

7. Third-Party Services
Mudra Magic does not use any third-party plugins.
8. Intellectual Property
All of the content in Mudra Magic is owned by Benjamin Marks, CEO of Supreme Ultimate Applications, LLC, except for:

9. Limitation of Liability and Disclaimers
Mudra Magic is intended for general wellness and fitness purposes only. The techniques depicted could cause physical injury. Users should follow the safety instructions (accessible from the Mudra Magic app’s main menu panel) whenever practicing the mudras.
Use of Mudra Magic is at your own risk. The content of Mudra Magic is being provided “as is” and “as available” without warranties of any kind, either express or implied. Supreme Ultimate Applications, LLC, and Benjamin Marks disclaim all warranties with respect to the foregoing, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, Supreme Ultimate Applications, LLC, and Benjamin Marks do not represent that the content of Mudra Magic is accurate, complete, reliable, current, or error-free, or that access to the app or any content provided therein or therewith will be uninterrupted. While Supreme Ultimate Applications, LLC, and Benjamin Marks attempt to make your use of the app safe, and any content provided therein or therewith, we cannot and therefore do not represent or warrant that the app, and/or any content provided therein or therewith, are free of viruses or other harmful components or content or materials. You assume the entire risk as to the quality and performance of the app, and any content or materials provided therein or therewith.
The techniques depicted in this mobile software application, known as Mudra Magic, could cause physical injury when an attempt is made to perform them. Benjamin Marks, Supreme Ultimate Applications LLC, and any other individuals involved in the production of this mobile software application assume(s) no responsibility for any injury or damage resulting from the execution of the exercises and techniques presented here. Again, please follow the safety instructions (accessible from the Mudra Magic app’s main menu panel) whenever practicing the mudras in order to minimize the risk of injury.
The representations of yogic mudras provided in this application are intended for general wellness and fitness purposes only. They are not intended to diagnose, treat, cure, or prevent any health condition or disease in particular. The content and tools within this application are not and should not be considered as professional medical advice or a replacement for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any new health care regimen. Mudra Magic is not intended to be a comprehensive course in mudras, far from it. There are hundreds if not thousands of mudras not included in MudraMagic. These are simply the most well known.

All disclaimers contained herein are made for the benefit of Supreme Ultimate Applications, LLC, and Benjamin Marks, their officers, directors, agents, as well as their respective successors and assigns.
To the fullest extent permitted by applicable law, Supreme Ultimate Applications, LLC, and Benjamin Marks will not be liable to you, your employees, agents or assigns, under any theory of liability (whether based in contract, tort, negligence, strict liability, warranty, or otherwise) for any indirect, consequential, exemplary, incidental, punitive or special damages, or lost profits, even if Supreme Ultimate Applications, LLC, and/or Benjamin Marks have been advised of the possibility of such damages.
To the fullest extent permitted by law, you agree to be liable for any breach of our Privacy Policy.
In any event, the total liability of Supreme Ultimate Applications, LLC, Benjamin Marks, their officers, directors, agents or assigns for any and all claims arising out of or relating to these Terms of Use, and/or the use of the Mudra Magic app, regardless of the form of the action, is limited to $100 USD. The limitations set forth in the previous sentence will not limit or exclude liability for the gross negligence, fraud, or intentional misconduct of Supreme Ultimate Applications, LLC, Benjamin Marks, their officers, directors, agents or assigns.
10. Release
To the fullest extent permitted by law, you release Supreme Ultimate Applications, LLC, and Benjamin Marks from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown (including claims of negligence), arising out of or related to your use of the Mudra Magic app.
11. Indemnification
To the fullest extent permitted by applicable law, you will indemnify, defend, and hold harmless Supreme Ultimate Applications, LLC, and Benjamin Marks, and their employees, agents, officers and directors from and against any losses, liabilities, claims, demands, expenses, or costs arising out of or related to (a) your access to or use of our services, (b) your user content or feedback, (c) your violation of these terms, (d) your violation, misappropriation, or infringement of any rights of another (including intellectual property rights or privacy rights) or (e) your conduct in connection with the use of Mudra Magic. You will promptly notify Supreme Ultimate Applications, LLC, at ben@taijitek.net of any and all claims, including third-party claims, and cooperate with Supreme Ultimate Applications, LLC, and Benjamin Marks in defending such claims, and pay all fees, costs, and expenses associated with defending such claims (including attorney’s fees). You also agree that Supreme Ultimate Applications, LLC, and Benjamin Marks will have total control of the defense and settlement, at their option, of any third-party claims.
12. Governing Law and Dispute Resolution
These Terms of Use are governed by the laws of the State of Florida and the State and Federal Courts located in Miami-Dade County, Florida shall have exclusive jurisdiction to resolve any claims which may arise from the use of Mudra Magic. Prior to filing any claim, User agrees that the parties shall attend mediation with a mutually agreeable mediator certified by the Supreme Court of the State of Florida.
13. Modifications to Terms
Supreme Ultimate Applications, LLC reserves the right to update these Terms of Use. Users will be informed of changes through a one-time popup window requiring agreement to the updated terms before accessing the Mudra Magic app.

15. Miscellaneous
The failure of Supreme Ultimate Applications, LLC, and Benjamin Marks to exercise or enforce any right or provision of these Terms of Use will not operate as a waiver of such right or provision. These Terms of Use constitute the entire agreement between the user of Mudra Magic and Supreme Ultimate Applications, LLC, and Benjamin Marks, relating to the subject matter herein, and supersede all prior agreements, representations, statements, and understandings between the parties.
By using Mudra Magic, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
