TaijiTek®: Interactive 3D Pocket Tai Chi Terms of Use

Welcome to TaijiTek®. These Terms of Use govern your use of our mobile application, hereby known as “the app” or TaijiTek®. In these Terms, “You” will refer to the user of the app, and “we” or “us” will refer to Supreme Ultimate Applications, LLC (the company that created TaijiTek®). By accessing or using TaijiTek®, you agree to comply with and be bound by these Terms of Use. Please read them carefully.
1. General Information
App Name: TaijiTek®
Description: TaijiTek® is an innovative mobile app for health and fitness education, focusing on Yang Style Tai Chi Chuan. It provides text, images, videos, and interactive 3D simulated environments to help users learn Tai Chi.
2. User Engagement and Content
Account Registration: No account registration is required to use TaijiTek®.
User-Generated Content: In the future, once the feature is implemented (NOTE: custom avatar uploads are NOT currently implemented), users with a paid TaijiTek® subscription should be able to upload their own custom 3D avatar within one scene. The uploaded avatar file data will not be stored once the scene is closed.
3. Acceptable Use
Users must use TaijiTek® in a manner that is lawful and respectful of others. No specific activities or behaviors are explicitly prohibited within the app.
4. Age Restrictions
There is no minimum age requirement for users of TaijiTek®. However, users should ensure they are capable of understanding and following these Terms of Use.
5. Subscriptions and Payments
TaijiTek® offers two subscription tiers:
Monthly Subscription: $8.99 per month
Yearly Subscription: $89.99 per year
Both subscriptions provide full access to the Core Concepts module and the 108 Posture Yang Style Tai Chi Form module, which includes various interactive features and advanced settings.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly, depending on your selection) unless cancelled at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price listed above.
Payment Processing: Payment and billing are managed by the Apple App Store (for iOS users) or Google Play (for Android users). We do not collect or store your payment information.
Managing Subscriptions: You can manage your subscription and turn off auto-renewal at any time through your Apple App Store account settings or Google Play account settings. Deleting the app will not cancel your subscription.
Refunds: All billing and refund matters are handled directly by Apple or Google according to their respective policies. We do not provide refunds for unused portions of a subscription period.
6. Data Collection and Use
In the future, once the custom avatar uploads feature is fully implemented, the TaijiTek® app may temporarily store said user-uploaded custom avatars, which will be used solely within the TaijiTek® app in order to allow users to learn Tai Chi from their own uploaded avatar instead of the default avatars. Since the uploaded data will not be stored in the TaijiTek® app once the app is closed, nor will it be transmitted by any means to any external database, it is not to be considered as “data collected” by Supreme Ultimate Applications, LLC.
We do, however, collect certain technical data such as device specifications in order to improve TaijiTek® and keep it functioning properly over time. Additionally, we use third-party services such as Google analytics and SquareSpace analytics in order to collect and monitor data based on user interactions with the TaijiTek® app, with our website https://www.taijitek.net, and with our advertisements.

7. Third-Party Services
TaijiTek® does not currently use any third-party plugins, however in the future the following third-party plugins may be implemented in order to accommodate a custom avatar uploading feature:

These plugins are legally licensed for use in TaijiTek® by Supreme Ultimate Applications, LLC through the Unity Asset Store.
8. Intellectual Property
All of the content in TaijiTek® is owned by Benjamin Marks, CEO of Supreme Ultimate Applications, LLC, except for:

TaijiTek®, the circular TaijiTek® "TT Yin Yang" logo, and Supreme Ultimate Applications™ are trademarks of Supreme Ultimate Applications, LLC.
9. Limitation of Liability and Disclaimers
TaijiTek® is intended for general wellness and fitness purposes only. The techniques depicted could cause physical injury. Users should follow the recommended training order and read the embedded information panels in order to minimize the risk of injury. You can toggle these infopanels on and off by tapping on the “i” button in the user interface.
These representations of Tai Chi Chuan movement exercises are not professional medical advice and should not replace professional medical consultation. Use of TaijiTek® is at your own risk. The content of TaijiTek® is being provided “as is” and “as available” without warranties of any kind, either express or implied. Supreme Ultimate Applications, LLC, and Benjamin Marks disclaim all warranties with respect to the foregoing, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, Supreme Ultimate Applications, LLC, and Benjamin Marks do not represent that the content of TaijiTek® is accurate, complete, reliable, current, or error-free, or that access to the app or any content provided therein or therewith will be uninterrupted. While Supreme Ultimate Applications, LLC, and Benjamin Marks attempt to make your use of the app safe, and any content provided therein or therewith, we cannot and therefore do not represent or warrant that the app, and/or any content provided therein or therewith, are free of viruses or other harmful components or content or materials. You assume the entire risk as to the quality and performance of the app, and any content or materials provided therein or therewith.
The techniques depicted in this mobile software application, known as TaijiTek®, could cause physical injury when an attempt is made to perform them. Benjamin Marks, Supreme Ultimate Applications LLC, and any other individuals involved in the production of this mobile software application assume(s) no responsibility for any injury or damage resulting from the execution of the exercises and techniques presented here. Please take great care to train in the proper order, first working through the “Free Warmup Exercises” training module for a period of weeks before moving on to the 108 posture Yang Style Tai Chi form in order to minimize the risk of injury. Additionally, make sure to read the embedded information about each animation before attempting the movement yourself.

They are not intended to diagnose, treat, cure, or prevent any health condition or disease in particular. TaijiTek® is not intended to be a complete Tai Chi instruction, far from it. The study of Tai Chi is like a vast ocean; there are many aspects of the practice that you cannot yet learn from an animated interactive 3d hologram (AI3DH). The nuances of the position and function of the hands in Tai Chi practice are not completely captured by the AI3DH due to limitations of the motion capture technology I had at my disposal at the time of recording. Luckily, there is information about the hand postures in the core concepts module, in addition to in the embedded information panels in the long form module. To the fullest extent permitted by applicable law, Supreme Ultimate Applications, LLC, and Benjamin Marks will not be liable to you, your employees, agents or assigns, under any theory of liability (whether based in contract, tort, negligence, strict liability, warranty, or otherwise) for any indirect, consequential, exemplary, incidental, punitive or special damages, or lost profits, even if Supreme Ultimate Applications, LLC, and/or Benjamin Marks have been advised of the possibility of such damages.
To the fullest extent permitted by law, you agree to be liable for any breach of our Privacy Policy.
In any event, the total liability of Supreme Ultimate Applications, LLC, Benjamin Marks, their officers, directors, agents or assigns for any and all claims arising out of or relating to these Terms of Use, and/or the use of the TaijiTek® app, regardless of the form of the action, is limited to $100 USD. The limitations set forth in the previous sentence will not limit or exclude liability for the gross negligence, fraud, or intentional misconduct of Supreme Ultimate Applications, LLC, Benjamin Marks, their officers, directors, agents or assigns.
10. Release
To the fullest extent permitted by law, you release Supreme Ultimate Applications, LLC, and Benjamin Marks from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown (including claims of negligence), arising out of or related to your use of the TaijiTek® app.
11. Indemnification
To the fullest extent permitted by applicable law, you will indemnify, defend, and hold harmless Supreme Ultimate Applications, LLC, and Benjamin Marks, and their employees, agents, officers and directors from and against any losses, liabilities, claims, demands, expenses, or costs arising out of or related to (a) your access to or use of our services, (b) your user content or feedback, (c) your violation of these terms, (d) your violation, misappropriation, or infringement of any rights of another (including intellectual property rights or privacy rights) or (e) your conduct in connection with the use of TaijiTek®. You will promptly notify Supreme Ultimate Applications, LLC, at ben@taijitek.net of any and all claims, including third-party claims, and cooperate with Supreme Ultimate Applications, LLC, and Benjamin Marks in defending such claims, and pay all fees, costs, and expenses associated with defending such claims (including attorney’s fees). You also agree that Supreme Ultimate Applications, LLC, and Benjamin Marks will have total control of the defense and settlement, at their option, of any third-party claims.
12. Governing Law and Dispute Resolution
These Terms of Use are governed by the laws of the State of Florida and the State and Federal Courts located in Miami-Dade County, Florida shall have exclusive jurisdiction to resolve any claims which may arise from the use of TaijiTek®. Prior to filing any claim, User agrees that the parties shall attend mediation with a mutually agreeable mediator certified by the Supreme Court of the State of Florida.
13. Modifications to Terms
Supreme Ultimate Applications, LLC reserves the right to update these Terms of Use. Users will be informed of changes through a one-time popup window requiring agreement to the updated terms before accessing the app.

15. Miscellaneous
The failure of Supreme Ultimate Applications, LLC, and Benjamin Marks to exercise or enforce any right or provision of these Terms of Use will not operate as a waiver of such right or provision. These Terms of Use constitute the entire agreement between the user of TaijiTek® and Supreme Ultimate Applications, LLC, and Benjamin Marks, relating to the subject matter herein, and supersede all prior agreements, representations, statements, and understandings between the parties.
By using TaijiTek®, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
